These Terms of Service ("Terms") govern your use of SnapQuota's photo sharing platform and services (the "Service"). By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not access or use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

SnapQuota is a photo sharing platform that allows users to:

• Create and manage unlimited photo sharing events (FREE)
• Upload and share photos with event participants
• Manage photo quotas and user permissions
• Download and organize event photos
• Purchase optional photo bundles for additional storage

The Service provides free event creation with optional paid photo bundles for additional storage capacity.

3. User Accounts and Registration

Account Creation

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account

Account Security

You are responsible for maintaining the security of your account. You must notify us immediately of any unauthorized use of your account.

4. Photo Upload and Content Policy

Your Content

You retain ownership of all photos and content you upload to SnapQuota. By uploading content, you grant us a limited license to:

• Store, process, and display your content as necessary to provide the Service
• Create backups and ensure data security
• Generate thumbnails and optimize images for performance

Content Restrictions

You agree not to upload content that:

• Violates any laws or regulations
• Infringes on intellectual property rights
• Contains harmful, offensive, or inappropriate material
• Violates privacy rights of others
• Contains malware or malicious code

5. User-Generated Content & Responsibility

User-Generated Content

SnapQuota allows users and event guests to upload photos and other content ("User Content") to shared event galleries. By uploading content, you agree that:

• You own or have permission to share the photos you upload
• You will not upload any content that is illegal, offensive, infringing, or violates another person's rights
• All content uploaded by guests is the sole responsibility of the person who uploaded it, not SnapQuota
• SnapQuota does not pre-screen uploaded content and is not responsible for monitoring or moderating content posted by users
• You agree to indemnify and hold harmless SnapQuota from any claim arising from content you or your guests upload

6. Pricing and Payment

Free Events

Event creation is completely FREE. Each free event includes:

• 25 photos included
• 1 month photo retention
• No gallery or slideshow access
• 3 free events per month limit

Photo Bundles (Optional)

Purchase additional storage capacity with photo bundles:

• Starter Bundle: $4.99 AUD - 50 photos, 6 months retention
• Medium Bundle: $14.99 AUD - 500 photos, 6 months retention
• Standard Bundle: $24.99 AUD - 1,000 photos, 6 months retention
• Pro Bundle: $79.99 AUD - 5,000 photos, 12 months retention

Payment Terms

All bundle purchases are processed through secure third-party payment processors. Payments are non-refundable except as required by law.

Photo Quota and Usage Policy

Photo quotas are allocated based on your selected bundle and are valid for the duration specified in your purchase. Please note the following important terms regarding quota usage:

• Unused Quota: Any unused photo quota remaining at the end of your event or retention period will expire and cannot be carried forward to future events
• No Refunds for Unused Quota: We do not provide refunds, credits, or compensation for unused photo quota, regardless of the reason for non-usage
• Quota Expiration: Photo quotas expire according to the retention period specified in your bundle (1 month for free events, 6-12 months for paid bundles)
• Bundle Stacking: Additional bundles can be purchased at any time to increase your event's photo capacity

7. Prohibited Uses

You agree not to use SnapQuota for:

• Any unlawful purpose or in violation of any laws
• Transmitting spam, viruses, or malicious code
• Attempting to gain unauthorized access to our systems
• Interfering with the proper functioning of the Service
• Creating multiple accounts to circumvent quotas or restrictions
• Commercial use without permission
• Harassment, abuse, or harm to others

8. Intellectual Property

Our Rights

SnapQuota and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

Your Rights

You retain ownership of your photos and content. You grant us only the limited rights necessary to provide the Service.

9. Service Availability

We strive to provide reliable service, but we cannot guarantee:

• Uninterrupted access to the Service
• Error-free operation
• Compatibility with all devices or browsers
• Data loss prevention

We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.

10. Limitation of Liability

Our total liability to you for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in the app.

Termination by Us

We may terminate or suspend your account immediately if you violate these Terms, engage in fraudulent activity, or abuse the Service.

12. Governing Law

These Terms are governed by the laws of Australia. Any disputes arising from these Terms or the Service shall be resolved in the courts of Australia.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website, sending you an email notification, or providing notice through the app.
